1. About This Policy

This Cancellation & Refund Policy explains how cancellations, project termination, and refund requests are handled for services provided by YNCO Studio (“YNCO”, “YNCO Studio”, “we”, “us”, or “our”).

YNCO Studio provides customized creative and digital services, including web design, website development, digital design, motion-related work, and related project services.

Because each project may involve customized work, reserved production capacity, project planning, third-party expenses, and work performed specifically for a client, refund eligibility depends on the circumstances of the project, the applicable Project Agreement, and mandatory law.

2. Relationship With the Project Agreement

Each project may be governed by a separate proposal, statement of work, project agreement, contract, invoice, or other written commercial terms (“Project Agreement”).

The Project Agreement may define project-specific matters including:

  • Scope;
  • Deliverables;
  • Timeline;
  • Milestones;
  • Payment schedule;
  • Deposits or advance payments;
  • Third-party costs;
  • Cancellation conditions;
  • Revision limits;
  • Intellectual property transfer;
  • Other project-specific obligations.

Where a Project Agreement contains specific cancellation or refund terms, those terms apply to that project to the extent permitted by applicable law.

This Policy supplements, and does not replace, the YNCO Studio Terms of Service or any applicable Project Agreement.

Mandatory legal rights always prevail where they cannot lawfully be waived or limited.

3. Cancellation by the Client

A client may request cancellation of a project by contacting YNCO Studio in writing at:

legal@yncostudio.com

The cancellation request should identify the relevant project and, where available, the invoice or payment reference.

The financial consequences of cancellation depend on the status of the project at the time we receive the request.

Factors may include:

  • Work already performed;
  • Milestones already completed or substantially completed;
  • Production capacity already reserved for the project;
  • Approved or delivered materials;
  • Non-recoverable third-party expenses;
  • Licenses, subscriptions, assets, contractors, or services acquired specifically for the project;
  • Any project-specific cancellation terms agreed in writing;
  • Mandatory rights under applicable law.

Cancellation does not automatically entitle the client to a full refund.

4. Cancellation Before Work Begins

If a client requests cancellation before substantive project work has begun, YNCO Studio will review any amounts already paid and determine whether a full or partial refund is due.

Where legally permitted, amounts corresponding to costs already incurred, non-recoverable third-party commitments, or other obligations already undertaken specifically for the project may be excluded from a discretionary refund.

If the applicable Project Agreement contains specific terms for an advance payment, booking payment, project reservation, or deposit, those terms will also be considered.

Nothing in this section limits mandatory cancellation or withdrawal rights that apply under law.

5. Cancellation After Work Has Begun

Once work has begun, payments attributable to work already performed, completed milestones, approved work, or properly incurred project costs are generally not refundable except where required by law or otherwise agreed in writing.

If the client has paid more than the amount attributable to:

  • Work already performed;
  • Completed or substantially completed milestones;
  • Non-recoverable third-party costs;
  • Other amounts properly due under the Project Agreement;

YNCO Studio will assess whether the remaining prepaid balance is refundable.

Any refund may therefore be full, partial, or unavailable depending on the project status and applicable terms.

6. Third-Party Costs

Projects may involve third-party products or services, including, for example:

  • Domain registrations;
  • Hosting;
  • Software subscriptions;
  • Premium fonts;
  • Stock assets;
  • Plugins;
  • External platforms;
  • Contractor or collaborator costs;
  • Other licenses or services acquired specifically for the project.

Where a third-party charge is non-refundable or has already been irrevocably incurred for the client’s project, it may be excluded from a discretionary refund where permitted by law.

Third-party providers may also apply their own refund and cancellation rules.

7. Delays, Inactivity, and Client Responsibilities

Projects often require timely information, content, approvals, feedback, credentials, and decisions from the client.

If a project is delayed or suspended because the client does not provide required materials, approvals, payment, or communication, this does not automatically create a right to a refund.

YNCO Studio may suspend or terminate a project in accordance with the Terms of Service and applicable Project Agreement.

Amounts already due for completed work, reserved work where contractually applicable, or properly incurred expenses may remain payable, subject to applicable law.

8. Cancellation by YNCO Studio

YNCO Studio may suspend or terminate a project in circumstances permitted by our Terms of Service, Project Agreement, or applicable law, including material breach, non-payment, abusive conduct, unlawful requests, or prolonged client inactivity.

If YNCO Studio terminates a project for reasons unrelated to a client breach and is unable to complete services for which the client has already paid, we will assess the unused prepaid portion of the project and provide an appropriate refund for services not performed, subject to any properly incurred non-recoverable costs and applicable law.

Where appropriate, work already paid for and capable of being delivered may be provided to the client.

9. Mandatory Consumer Rights

Nothing in this Policy removes or restricts rights that a consumer may have under mandatory consumer protection law.

For Brazilian consumers, where the Brazilian Consumer Protection Code applies and the legal requirements for the statutory right of withdrawal are met, Article 49 may provide a 7-day withdrawal period for contracts entered into outside a commercial establishment, including certain remote or online contracts.

Where such mandatory right applies, YNCO Studio will honor it in accordance with applicable law, including the required refund of amounts paid.

Different consumer protection rules may apply in other jurisdictions.

10. How to Request a Cancellation or Refund

To request a cancellation or refund, contact:

legal@yncostudio.com

Please include, where available:

  • Your name;
  • Company or project name;
  • Email used for the project;
  • Invoice or payment reference;
  • Date and amount of payment;
  • Reason for the request;
  • Any relevant supporting information.

We may request additional information reasonably necessary to identify the payment, verify the request, or evaluate the project status.

YNCO Studio aims to acknowledge and review requests within a reasonable period, ordinarily within 5 business days, although complex cases may require additional time.

This review period does not delay any refund or response that applicable law requires to be handled within a shorter or immediate timeframe.

11. Approved Refunds

If a refund is approved, YNCO Studio will initiate it using the original payment method where reasonably possible, unless another method is required or agreed.

The time for funds to appear in the client’s account depends on the payment provider, card network, financial institution, currency, and payment method.

For card payments processed through Stripe, refunds commonly take approximately 5 to 10 business days after they are initiated to appear in the customer’s account.

YNCO Studio does not control processing delays caused by banks, card networks, or payment providers.

Where legally permitted, a refund may be reduced by non-recoverable third-party costs or other amounts properly due under the applicable Project Agreement.

Mandatory statutory refunds will not be reduced in a manner prohibited by law.

12. Currency and Exchange Rates

For international payments, the amount received by a client after a refund may be affected by:

  • Exchange-rate movements;
  • The client’s bank or card issuer;
  • Currency conversion;
  • The payment provider’s processing rules.

YNCO Studio will refund the amount approved in relation to the original transaction. We do not control independent exchange-rate differences or charges imposed by the client’s financial institution, except where applicable law provides otherwise.

13. Disputes and Chargebacks

If you believe there is an issue with a payment or project, please contact YNCO Studio before initiating a chargeback or payment dispute so we have an opportunity to review and address the matter.

Submitting a chargeback does not automatically determine the contractual or legal merits of a refund request.

YNCO Studio may provide the relevant payment provider or financial institution with documentation concerning:

  • The Project Agreement;
  • Scope and deliverables;
  • Client approvals;
  • Communications;
  • Work performed;
  • Payment records;
  • Applicable cancellation and refund terms.

Nothing in this section restricts any legal right to dispute a transaction where such right applies.

14. Changes to This Policy

We may update this Cancellation & Refund Policy from time to time to reflect changes in our services, payment processes, commercial practices, or legal obligations.

The latest revision date appears at the top of this page.

Changes will not retroactively remove mandatory rights or alter binding project-specific terms in a manner prohibited by applicable law.
